TERMS OF USE POLICY

Welcome to yogvalley.in (the “Site” or “Website”). This website is owned and operated by Yogvalley. We offer this Site (including all information, tools, Products, and services, collectively, “Services”) to you, the user, conditioned upon your acceptance of all of the following terms and conditions, including those additional guidelines, terms, and policies referenced herein and available on the Site (collectively, “Terms and Conditions” or “Terms” or “Terms of Use”). Please note that underlined words and phrases in this Agreement are links to pages on the Site.

ACCEPTANCE OF TERMS

By accessing or using any part of the site or services, or purchasing any product through the site, you represent that (a) you are eighteen (18) years of age or older and you have read, understood and agree to be bound by these terms or (b) if you are less than eighteen (18) years of age, your legal guardian has reviewed and agreed to these terms. If you do not agree to all the terms, or you are not willing or able to make the representations described above, then you may not access or use the site, the services, or purchase any product through the site. Any additional or different terms proposed by you in any communication are deemed material, are objected to, and are hereby rejected unless specifically accepted in a signed writing by an authorized representative of Yogvalley. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.

COPYRIGHT AND TRADEMARK

You acknowledge that all intellectual property rights in our Site, Services, and the underlying technology, and all information and content available on our Site and through the Services, excluding Your Content are owned by Yogvalley and our suppliers (including other users). Service Content is protected by international copyright laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicenseable, revocable license to view and use the Service Content for your personal non-commercial purposes. No other use of the Service Content is authorized. In consideration of this authorization, you agree that any copy of the Service Content that you make shall retain all copyright and other proprietary notices in the same form and manner as on the original. You may not otherwise use, download, upload, print, display, perform, reproduce, publish, license, post, transmit, modify, create derivative works of, reverse engineer, disassemble, decompile, adapt, distribute, transfer, or exploit any Service Content in whole or in part without our prior written authorization. We and our suppliers (including other users) reserve all rights not granted in this Agreement. There are no implied licenses.

All trademarks, service marks, trade names, logos and trade dress, whether registered or unregistered (collectively the “Marks”) that appear on the Sites and Apps are proprietary to Yogvalley or such Marks’ respective owners. In addition, all page headers, custom graphics, button icons, and scripts are trademarks, service marks, trade names, and/or trade dress of Yogvalley or their respective owners and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Yogvalley.

USAGE RESTRICTIONS

The Sites and Apps may be accessed and used only by individuals who can form legally binding contracts under applicable laws, who are 18 years of age or older, and who are not barred from using the Sites and Apps under applicable laws.

The Sites and Apps are provided solely as a convenience to you for non-commercial use. You may access and use the Sites and Apps only in accordance with all applicable laws and regulations and with these Terms of Use. You acknowledge and agree that Yogvalley, in its sole discretion, reserves the right to reject the registration and debar you from using the services of yogvalley.in. You further agree that you will not: (a) resell for commercial purposes products purchased through the use of the Sites; (b) resell or make commercial use of the Sites or Apps or Content therein; (c) other than for your use of the Sites and Apps as expressly permitted in these Terms of Use, access or attempt to access any systems or servers on which the Sites and Apps are hosted or modify or alter the Sites and Apps in any way;

Any unauthorized use of the Sites and Apps will terminate the permission or license granted by these Terms of Use, will result in you being barred from use of the Sites and Apps, and may violate applicable law including copyright laws, trademark laws (including trade dress), and communications regulations and statutes.

COLORS

We have made every effort to display the colors of our products that appear on the Website as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

USER ACCOUNT

In order to purchase products or services through the use of the Sites, you must establish an account with Yogvalley. You are solely responsible and liable for all activities, including, without limitation, all purchases of products and services through the use of the Sites that occur under your account or your account password.

You acknowledge and agree that Yogvalley may access, preserve, and disclose your account information, all communications to and from you, all information relating to your use of the Sites, and all information relating to the use of the Sites under your account or account password if Yogvalley is required to do so by law or legal process or if Yogvalley determines, in its sole discretion, that such action is necessary to protect the rights of Yogvalley, third parties, and other users of the Sites or for purposes of responding to your request for customer service.

TERMS OF SALE

You consent to receive electronic communications from Yogvalley either in the form of email/sms sent to you at the email address/mobile number listed on your account or by communications posted on the Sites and Apps. You acknowledge and agree that any electronic communication in the form of such email/sms or posting on the Sites shall satisfy any legal requirement that such communication be in writing.

BUYER’S ARRANGEMENT WITH ISSUING BANK:

All Valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company.

All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank which supports Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank.

INDEMNITY

You agree to indemnify, defend and hold Company and its officers, directors, and employees entirely harmless from and against any and all demands, costs, damages, liabilities, and expenses arising out of any third party claims relating to (i) your use of the Site, (ii) your breach of any of the Terms, or (iii) your violation of any applicable law, regulation or right of any third party.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT COMPANY SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY DAMAGES SUFFERED AS
